Foreign Language Filing (Article36-2)
In “Paris route” application into Japan, is it possible to file a patent application with a foreign language other than English.
Applicant can file a patent application in Japan in Any languages:
Under the Japanese patent act, Article 36-2, application documents must be prepared and filed in Japanese, but specifications, scope of claims, drawings (where required) and abstract, that are written in any language can be attached.
Applicant must file a Japanese translation within 16 months from a priority date. Basically, the Japanese translation is a basis of amendment. However, it is also possible to correct the translation error based on the original “foreign language documents”.
The normal filing fee is 14,000JPY (around 130-140USD) while the foreign language filing fee is 23,000JPY (around 220USD), a little bit expensive, not very expensive.
